US Judge Orders Release of Abrego Garcia from ICE Custody

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.

"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.

The case stems from a erroneous removal to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to answer alien smuggling allegations, he was held in immigration custody.

In her decision, the judge noted that the authorities lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The court proceedings involve disputed assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in Tennessee.

The court, who was overseeing his petition to deportation in a Maryland district court, ruled that he must now adhere to the terms of his release from jail in Tennessee. This decision shifts his monitoring to the Tennessee court.
